Section 35 - Local Authority to Consult Fire Brigade

New or proposed new development leading to difficulty accessing existing residential property.

According to S. 35 of the above Act the Eastbourne Borough Council are required to consult with the Fire Brigade to ascertain compliance and to take into consideration the recommendations of the Fire Officer to be reflected in the decision making process against their own local policies as to parking and development density levels.  So far the planning case officer has not reported the matter to committee with regard to the clear requirements of the above legislation and the implications of this council's local policies regarding refusal.

It remains to be seen if this council complies.  A failure to comply may render any permission voidable - Buyer Beware.
